Welcome to Ascend Trailer Rentals. This website, located at www.ascendtrailerrentals.com (the "Site"), is
owned and operated by Ascend Trailer Rentals, LLC ("we", "us", or "our"). By accessing or using our Site,
making a reservation, or purchasing services, you (the "User" or "Customer") agree to be bound by the
following terms and conditions ("Terms of Service", "Terms"). If you do not agree to all of these Terms, you
may not access the Site or use our services.
1. ELIGIBILITY AND ACCOUNT RESPONSIBILITY
To browse this Site or request a trailer rental reservation, you must be at least 21 years of age (or the
legal age required to rent commercial towable equipment in your jurisdiction) and possess a valid driver’s
license. By using this Site, you represent that you meet these requirements. You are responsible for
ensuring that all information you provide on our Site is accurate, current, and complete.
2. RENTAL RESERVATIONS AND BOOKINGS
Submitting a reservation request or payment through our website does not guarantee a rental. A rental
booking is only finalized once we verify your credentials and issue a formal confirmation.
• Request vs. Confirmation: A rental booking is only finalized once we verify your rental credentials
(including but not limited to driver's license verification, tow vehicle compatibility, and proof of
adequate auto insurance coverage) and issue a formal reservation confirmation.
• Rental Agreement: All rentals are subject to our separate, legally binding Trailer Rental Agreement,
which must be executed electronically or in person prior to hook-up and equipment release. In the
event of a conflict between these website Terms of Service and the explicit signed Trailer Rental
Agreement, the terms of the Trailer Rental Agreement shall control.
3. PAYMENT GATEWAY AND FEES
• Billing Infrastructure: We use Stripe as our third-party payment processing gateway. By submitting
payment or credit card details, you authorize Stripe to process transaction charges, administrative
fees, and any applicable security deposit holds on our behalf.
• Pricing Errors: We reserve the right to cancel or refuse reservations resulting from typographical or
pricing errors on the Site.
4. INTELLECTUAL PROPERTY
All content on this Site—including text, graphics, logos, button icons, images, and software—is the
property of Ascend Trailer Rentals, LLC or its content suppliers and is protected by United States and
international copyright laws. You may not reproduce, duplicate, copy, sell, or exploit any portion of the Site
without express written permission from us.
5. PROHIBITED USES
In addition to other prohibitions set forth in these Terms, you are prohibited from using the Site or its
content:
• For any unlawful purpose or to solicit others to perform unlawful acts.
• To violate any international, federal, provincial, or state regulations, rules, or local ordinances.
• To submit false, deceptive, or misleading identity information, driver’s licenses, or insurance
documents.
• To upload or transmit viruses, malware, or any other type of malicious code that could impact the
functionality of the Site.
6. DISCLAIMER OF WARRANTIES & LIMITATION OF LIABILITY
The Site and all information, products, and services delivered to you through the Site are provided on an
'as is' and 'as available' basis for your use, without any warranties of any kind, either express or implied.
In no case shall Ascend Trailer Rentals, LLC, our directors, officers, employees, or agents be liable for any
injury, loss, claim, or any direct, indirect, incidental, punitive, or consequential damages of any kind arising
from your use of the website platform or services booked via the platform.
7. GOVERNING LAW
These Terms of Service and any separate agreements whereby we provide you services shall be
governed by and construed in accordance with the laws of the State of Nebraska, without regard to
conflict of law principles. Any legal actions arising out of these Terms must be filed in the state or federal
courts located in Buffalo County, Nebraska.
8. CHANGES TO TERMS OF SERVICE
We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms of
Service by posting updates and changes to our website. It is your responsibility to check our website
periodically for changes.
